Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your access to heroespickleball.com and Heroes Pickleball courts, reservations, coaching, events, profiles, and community features (collectively, the “Service”). By creating an account, making a booking, registering for an event, or using the Service, you agree to these Terms and any facility or booking policies presented at checkout.
2. Eligibility and accounts
You must be at least 13 to use an account. If you are under the age of legal majority where you live, a parent or legal guardian must approve your use, participation, and purchases. You must provide accurate information, use only your own account, and protect access to your email, phone, and sign-in codes. Tell us promptly if you suspect unauthorized use.
3. Reservations, lessons, and events
Availability is not guaranteed until a booking is confirmed. Temporary holds may expire. You agree to arrive on time, follow posted facility and safety rules, respect capacity limits, and leave the court ready for the next players. Specific cancellation, refund, guest, equipment, veteran-pricing, and conduct rules shown during booking are incorporated into these Terms.
Heroes may modify, relocate, reschedule, or cancel a reservation, lesson, or event because of weather, safety, maintenance, staffing, low participation, emergencies, or circumstances outside reasonable control. When appropriate, we will provide notice and handle credits or refunds under the policy applicable to that purchase.
4. Prices and payments
Prices, fees, discounts, and eligibility are shown before confirmation and may change for future purchases. You authorize our payment providers to charge the selected method for purchases you approve. Taxes may apply. Veteran or promotional pricing may require verification and may not be transferred. Chargebacks submitted without first attempting to resolve a valid billing issue may result in account restrictions.
5. Player conduct
Keep it competitive, welcoming, and safe. You may not harass, threaten, discriminate against, impersonate, stalk, spam, defraud, or endanger another person; damage property; cheat eligibility or payment systems; access another account; scrape member data; introduce malicious code; or use the Service for unlawful purposes. Match requests and profile features may be used only for genuine pickleball and community activity.
6. Your content and privacy
You keep ownership of profile photos, messages, and other content you submit. You give Heroes a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and display that content only as needed to operate, secure, and improve the Service according to your settings. You represent that you have the rights needed to submit it. We may remove content or restrict visibility when reasonably necessary for safety, policy enforcement, or legal compliance.

7. Physical activity and assumption of risk
Pickleball and related activities involve inherent risks, including collisions, falls, equipment impacts, overexertion, illness, serious injury, or death. You are responsible for deciding whether you are fit to participate, using appropriate equipment, following safety instructions, and stopping when conditions are unsafe. To the fullest extent permitted by law, you voluntarily assume the ordinary and inherent risks of participation. These Terms do not waive rights that cannot legally be waived, and a separate facility waiver may also apply.
8. Service availability and disclaimers
We work to keep the Service accurate and available, but schedules, availability, prices, third-party services, and communications may sometimes be delayed or incorrect. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Nothing here limits warranties or consumer rights that cannot legally be excluded.
9. Limitation of liability
To the fullest extent permitted by law, Heroes and its owners, staff, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities arising from the Service. Our aggregate liability for a claim relating to the Service will not exceed the greater of the amount you paid Heroes for the activity giving rise to the claim during the prior six months or $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
10. Suspension and termination
You may stop using the Service at any time. Heroes may suspend or terminate access, cancel pending activity, or preserve relevant records when reasonably necessary for safety, nonpayment, fraud, repeated policy violations, legal compliance, or protection of the community. Provisions that by their nature should survive termination will survive.
11. Disputes and governing law
Please contact us first so we can try to resolve a concern informally. These Terms are governed by the laws of the state where Heroes Pickleball principally operates, without regard to conflict-of-law principles, except where the law where you live requires otherwise. Claims may be brought in a court with lawful jurisdiction. These Terms do not require arbitration and do not waive a consumer’s right to bring an eligible claim in small-claims court.
12. Changes and contact
We may update these Terms as the Service evolves. The revised Terms will be posted here with a new effective date. Material changes may be announced through the Service. Continuing to use the Service after updated Terms become effective means you accept them.
